They pass each other quite close with modern navigation aids, so probably no one on watch
 
Looks like the US one was at anchor.

AIS would show collision warning. But if the anchored vessel is not showing the correct day shape / anchor lights. then they have a problem. I can’t see a black ball on the bow, but it may have burned already.
