Party wall act - sub soil drainage?

Hi All,

I'm building a garage that will be almost on the boundary line between my house and my neighbours. It will be stepped back 50mm from it. Due to a soil build up on their side (the house is built on a slope) one of my walls needs to be tanked etc. I know that under the party wall act foundations can step over the boundary but what is the rules regarding subsoil drainage? If it is down at foundation level is this allowed?

For what it's worth my foundation has been designed so it sits directly on the boundary line i.e. extends 50mm past the blockwork.

I'm not 100% on scots law, but I'd say that anything across the boundary is a trespass

The PWA does not apply to Scotland either
