Patio Issue - Concrete not set and swelled

Use a wetter ( i.e. less dry mix) for the mortar, from what you say the sub base isn't a problem with the rest of the patio.

The flags on your patio are not butt jointed, you can clearly see gaps,was this done to help drainage? they will move/slide, but if flags are pushing up the problem will be the sub base too.
 
The flags were butt jointed until they all started moving. I cant understand it being the sub base when where 3 flags were relaid that are part of the original path at the same time as the new patio, these 3 flags have lifted too but the original path is fine/same sub base, its like base has swelled. On the new patio where the hot tub was, this is now down and the base under it is completely flat too.
