Received an 'Alleged Breach of Condition' from Council Planning Control - Help!

The notice can be served on the responsible person and this is any person who has developed the job or the person owning the land. But in the latter case can only relate to a planning condition on the use of the land.
The person who started the building is the neighbour and is the person responsible.

Pretty sure that is wrong. An Enforcement Notice can only be served upon a party who has an ownership interest in the land.
