The father, being a US citizen, with a child who is also a usa citizen has more rights (right or wrong, but it's how the USA works) than the mother, especially as she is not a USA citizen.

Whether those in charge will uphold their constitutuonal rights is another matter.

They havent made that clear.

However I cant see how the baby could have American citizenship unless one of the parents was a citizen
 
Nonsense, that's semantics. The court are questioning whether the correct procedures were followed and whether the mother and child were forcibly, and wrongly, removed from the US.
It's not semantics at all. A deported person cannot legally return to the US before 10yrs after the deportation date.
The child can return anytime.
Therefore they have not been deported.
The mother wanted her child to go with her.

I'm sure the two year old will get her lawyer onto it.

I don't actually think she was deported in the proper legal sense. The mother was deported and took the child with her. Whether the mother was bounced into that decision is another matter.
