Tub leak

OK so I'd take a guess and say it certainly looks like that could be the problem - both top and bottom seals compromised, time for a new bath waste methinks. I'd also get rid of the cabled pop up waste, they tend to leak just for fun. It will need you to get the overflow off too though.

Then it's just buy a new bath waste of your choice, most should be at roughly the same height for the trap and waste pipe. Only thing is the trap - that's a shallow bath trap and unless the waste pipe has an open end on it - empties out to a hopper or open gully - then it should really be proper trap used but it is what it is.

Thanks. I can get rid of the popup waste but why do I need to take the overflow off? (I could just take the black cable off at the end and leave it loose) Thing is the overflow and tap for the tub are in the same unit. So the overflow has a water inlet for cold and hot as well and a mixer on it.
 
Tub is on the first floor so I am guessing shallow trap is ok. Is an old house and drains go straight outside.

Ah ok - it's a combined overflow filler? The trouble would be getting a new waste that will take that overflow pipe, if you can get one the same size then great, if not then that may be a problem.
 
Yes it's the combined overflow filler. Will try to get the same size, else will have to think of another option. Here is the overflow pipe end.

I would always recommend McAlpine stuff, best I've found.

Clickers have their plusses and one minus but pop up's can be more troublesome IMO. Pop up cables can go, the mechanism can snap, it can leak. Clicker's can sometimes stop popping up too but that's as much as can go wrong and McAlpine seem to be better than most, the clicker mechanism is removeable and probably replaceable.

The old chain and plug is always the best but isn't very contemporary
