I found some earths today with red or black sleeving on instead of the usual green/yellow, do i note that as a departure or in comments on existing installation?

I'd want to be very sure that they were earths first. I'd stick it as a departure - its misleading at best and dangerous at worst.

They're definately earths just wrong sleeving, should i reeplace or just note it on EIC? Its for an assessment for NIC, i've changed CU but obviously inspected a few s/o and found them

If you've changed the CU then you are responsible for the final circuits.
They have to meet all requirements as if they had just been installed by you as you're completing an EIC for that installation.
This is the reason why a PIR should be carried out before a consumer unit change to verify that final circuits are suitable for use.

Would I be correct in saying this error would have to be corrected before or during the CU replacement?

This is very true. Probably why I rarely do CU changes, as the cost of the PIR on top of the change as well as remedials such as bonding etc. usually wack the cost way above the spark who will just change the CU. :D

Yes, after being highlighted by the periodic report carried out prior.

imo wrong sleeving is an error that should be corrected as soon as it is found.
