closeboard fencing-which side to neighbour?

My neighbour put up a closeboard fence three years ago to replace their old panel fence.
They had the board side but I have been told that I should have that side facing me.
The posts are also inside my boundary.
This was not really a problem until now as they are good friends.
But sadly they are moving, so I want to reclaim my bit of garden and have the boards on my side.
Can I still ask them to do this or have I left it too long? :confused:

youve been told a load of old rubbish. It used to be a convention that the good side faced to the neighbout that hadnt paid for it. this helped determine whose fence it was, but to be honest it has no standing and he who pays the fencer, gets the side they want.

Yeah!! but I will still ask them to move the posts which should be completely on their land. ;)

Of course, you can prove that they are on your land cant you?

the other option is to get them to sign over the entire fence to your ownership, then you can do what you want with it.

I would have no trouble proving that the posts were on my land as the original 4" post stumps are still there and you can see by eye that the new, larger posts do not line up with the center of the party wall as the old posts did. :eek:
Mine is a terraced property so it's easy to tell. ;)
I don't want to go to war over this---just get the posts moved,and not at my expense. I certainly don't want ownership--I have two fences to maintain as it is :rolleyes:

Sounds like war to me. You want them to pay for someone to come round and dig up the existing posts and re-set them 100mm in the other direction, and all just when they are trying to go through the stress of moving house!

Maybe you should just insist a clause in their conditions of sale that the fence be reinstated back to it's original position when the fence comes to be replaced next time round?

why did you leave it so long ?

They knew that it was in the wrong place---I just didn't insist that they corrected it at the time,that was a mistake.
Anyway we've now discussed it and will probably do as Deluks suggests and include moving it if I want to add to the house. :)
