Since the boiler is only half the expected distance to the boundary which is a guidance figure used by Building Control until its incorporated into statute, you have a valid complaint thta it has not been installed in accordance with current guidelines and is causing a statutory nuisence.
Many boilers can be fitted with a plume diverter but not all models!
You have three directions to complain to. Gas Safe ( less helpful 0 as they only have powers over registered people ), Building Control who are usually too busy and the Environmental Health Officer who have wide ranging powers to fine and close down causes of nuisence.
BS 5440-1 gives practical guidance to gas operatives when engaged in installing and maintaining gas appliance flues used in the domestic sector.
The standard, which should be read in conjunction with the particular manufacturers installation instructions for a given appliance, gives advice on a wide range of flues (type of flue), with particular importance being placed on there construction, route, termination etc.
What I would ideally liked to be armed with is something like part p of the regs that says his instal is in contravention of said regs. Or it that not so?
