Hi all, first post in years so bear with me please!
I am struggling to get retro planning permission for a Gazebo and kids tree house. I thought they would fall under permitted development PD and so kept them within the PD measurements allowed in the rear garden. Our house is not adjacent to a highway, it has a private access drive feeding four houses ours being the last some 80 plus yards from the main road.
Within the regs I studied intensely is a section with instructions on what is Principal Elevation PE.
At (i) it talks of an angle to the road of more than 45 degrees = not fronting a highway AND
At (ii) it talks about a substantial distance from the Road and passing over land in different ownership etc.
Our property has both clauses included and for these reasons I thought PD would apply to the structures. How wrong it seems I am!
Anyone come across this situation please? Our front garden stops just beyond the house where a garage and carport together with fences and gates close off the front garden. The gazebo and tree house are therefore in my book built in the rear garden meaning (I thought) PD would apply. Surely PE ends beyond the house - Council disagree!
Any thoughts please?
Exceptions to every rule I thought..

PD does not apply to tree houses no matter whether its in the front, back or side garden.

Good thought - trying to understand where I went wrong to ensure we learn from the experience I suppose!

"I'm sorry son, you can't have a tree house this week, you've got to wait 8 weeks until the man the council says yes" :D
 
Is each block a house? Five are numbered, one is unnumbered - is that yours at the end? What do the colours signify? Where are the tree house and gazebo?

The end block is our existing double garage with a carport attached to the west. At the rear the small box in red is the tree house, the square next to it is the gazebo for which retro planning is sought, proposed gazebo covering a spa is to the side of the garage, the two gazebos are to be linked with a covered walkway - subject to planning.

LDC - local District Council? not sure of Col...
