New patio over old

I have a very old patio that needs re-doing. it has been badly done with the slabs just sitting on sand and soil (no real hardcore). Although its uneven it's been there a long time and is probably quite settled. My plan is to mortar in a brick perrimiter, then lay sand/cement mix directly on top and then slabs. in other words I would be using the existing pation as a hardcore for the new one - is there any problems with doing it this way?

Does it abutt your house, would doing it the way you intend raise it above the DPC.
 
It's usually best to take up old slabs and lay new slabs on a fresh bed, but tbh i don't see much wrong with the way they look now.
