The father, being a US citizen, with a child who is also a usa citizen has more rights (right or wrong, but it's how the USA works) than the mother, especially as she is not a USA citizen.The child is a US citizen and is free to return to the US anytime. If the mother so wishes.

Nonsense, that's semantics. The court are questioning whether the correct procedures were followed and whether the mother and child were forcibly, and wrongly, removed from the US.So.. the child hasn't been deported.
