I would be if it was true but an opinion paper that actually has quite a few errors in it, hasn’t changed anything. Fortunately, their recommendations and conclusions are not law and the human rights act is very clear about how we should determine and address incompatibility.

If a small boat is deemed in distress based on its condition (as per the paper), they should be rescued when the set off.
