Gas flue modification carried out without permission!

so Deedee was a new boiler fitted in 2006.

My parents had no hot water or heat and, as my mother had been very seriously ill earlier in the year and was quite weak, they felt they had no alternative but to install a replacement (located elsewhere) as soon as they could.
The reason the solicitor or anyone else won't take it any further is nothing can be proven.
If it ends up in court, they'll say they asked for flue to be moved, you'll say they didn't, no documentation no proof.
The flue photo's look bad, but do you have a written report from an independent expert regarding the standard of work.
Do you still have the modified flue and boiler and related documents.
To make a case you need proof, not just an unhappy feeling about an unfortunate sequence of events.

So just to clarify ,, the flue which was modified was fitted at least 5yrs ago yeah ?
The modification was carried out by the neighbour so we have no paperwork. We also have no access to the shed or the wall as it abuts their land. They have never claimed to have consulted my parents prior to or concerning the modification, it simply came up as part of their defence in the matter.
