Gas flue modification carried out without permission!

Boilers have never been allowed to discharge across a boundary, more so if the wall is the boundary as the terminal is effectively in neighbours property. The neighbour would have had every right to request you move boiler as he wished to use wall.
OK granted he shouldn't have touched the flue and is being silly expecting payment.
For the sake of yours parents and the peace I'd let it drop, if the neighbour is still asking for money? If so tactfully explain that what he did was naughty and you'll drop it if they drop the money.
The issue with flue/boundary is more of an issue due to condense, the rules have always been there just never as stringently adhered to.
 
Of course there are issues, but the flue belongs to my parents, not to the neighbour, who never complained or took issue with it at any time, prior to enclosing it in a shed thus deliberately creating a danger to my parents.
 
Well, that is rather my point... they modified an appliance and created a danger. The man from Transco was horrified!

BTW does their wall sit right on the boundary ?
 
Gasman1965 It says boiler was there for 5 years but was cut off and replaced i would take that to be recent.
 
The dispute was partly about the shed and partly about occluding the flue. It was only when we saw photographs from a joint expert that we realised the flue had actually been modified. The dispute has been going on since July 2006 and I cannot get anyone to take the issue of the flue modification seriously. My opinion is that it potentially posed a serious health / safety hazard, but the solicitors are ignoring this aspect of the case.
 
The wall meets the boundary but does not cross it. It is not a party wall as it encloses one dwelling and is not shared.

The original boiler was installed in approx 2000//2001 and was disconnected in July 2006 after being declared unsafe by Transco and then by a British Gas Inspector who came to investigate the problem further.
 
How about the possibility that the neighbour did not want to cause a fuss and the expense to your parents of repositioning the boiler and in his opinion thought he was competent enough to extend the flue, (which clearly he was not), he was just trying to be a helpful neighbour

What about the fact they touched a gas appliance and modified it ?


There are thousands of boilers illegally installed each week without any fear of prosecution. An ignorant neighbour modifies a flue...big deal...the HSE won't even bother interviewing them.

The only winners here are the solicitors.

Transco are not normally qualified to make any judgement on a boiler flue.

A helpful neighbour would discuss modifications of someone else's property - with the owner of that property - before carrying out a potentially life-threatening modification, surely?
