I am looking to build an extension onto the side of my house. I have my neighbours complaining that the extension is too bug, however, one of the reasons why I want to make it that big is so that I can create a room, where I can pray, as there is no where else in my city, where there is a Hindu temple.

If my council reject my application, would it be discrimination?

The council would probably consider it in terms of a normal domestic extension if it is for your own use; as long as it stays within their guidelines with regard to size etc it would probably be approved.

If you are going to have friends/relatives coming round for services, that would be a completely different matter.

If it was refused for any reason, it would be on planning grounds. You would
find it difficult - if not impossible - to prove discrimination. The fact that there may be no temple nearby would probably not be valid grounds for an appeal against a refusal.

Crikey, you want to build a 'temple' but the neighbours object because they feel the extension is too big and even before the council have rejected your application, if they do, you're already talking of discrimination on religious grounds and stuff your neighbours opinions. Karma?

ah ha cant get want you want and use the discrimination route to bulldoze everyone else opinions to 1 side.

I've always found that a person who wants to pray can do it in any room, or in the open air, or even on a bus.

Does anyone actually know what religion, if any, the OP really has?

Perhaps he intends to have a bit of fun with us.

No.

It would only be discrimination if they rejected it because of your religion. As that is not a valid reason under planning law they cannot use that reason. Therefore if it is rejected it wouldn't matter if you were Hindu, Sikh, Christian, or atheist, as it would have been rejected for the same reason as anyone else submitting the same plans for that location.

By all means mention that you want to create a private prayer space for yourself/your family though as if it goes to committee that sort of thing may just sway a close decision in your favour.

Reminds me of an episode of The Planners where an application was in front of committee to build a mosque despite objections from planning on grounds that it was ugly, lacked adequate facilities or fire standards, complaints from highways about the potential chaos on the local roads and was well substandard with regards to parking space provision..

..it still passed
