hi people

im selling my house at the moment , however the original plans were for a single story dwelling , but the last owner put 2 x bedrooms in the roof ,when he was building the house ,25 years ago now the buyers solicitors are questioning this ,is this going to cause a big problem ?? any advice would be great.

Unless the Local Authority served an enforcement notice at the time of the construction or within the four period thereafter then it should be long immune from any form of enforcement action.

This is just another example showing how utterley stupid some so-called conveyancing solicitors can be. :rolleyes:

As above, if it's been up more than four years, no problem.

(And they will also be charging the buyers for the extra time on this nonsense).
 
All an indemnity does is protect you from legal costs should the council take action. It would not cover defective building work.
Also, such a policy only applies if the council are unaware of the work.

But why bother? Whatever is there became immune from enforcement action by the council at least over 20 years ago. Spend your money on more useful things.
 
These policies will probably be tomorrows PPI and CPP, selling you stuff that's completely pointless. But at the moment, it can be difficult to sell unless you tick all the boxes and jump through all the hoops.
 
ive had to go for the indemnity ,just to speed things up the house has been on the market for a long time and the buyer is getting itchy feet cant afford any messing about, estate agent said its because the upstairs didn't come under building regs at the time , as it was signed off as a single story house .

does that make sense ??
