Bedroom or office

We are selling our house that is a year old. When the house was built it had planning for a 2 bedroom house with a room in the roof that was clased as a home office witch we have used as a bedroom.

We have advitised the house for sale as a 3 bed house and have found our self a buyer.

The problem is there solicitor has said that we only have permision for a 2 bedroom house and that this may cause a problem.

Is She being realy perdantic or can we not use this room as a bedroom?

You can call it a bedroom as long as it complies with all the criteria for a bedroom. If it doesn't then you can't.
 
You can only class it as a bedroom if it complies with the relevant Building Regulations that would have deemed it as being lawful to use it as a bedroom when it was constructed.. This involves adequate natural daylight, escape routes and fire protection etc etc. There is no minimum size for bedrooms unless this was stipulated during or as part of the Planning Permission which is possible.

If it meets the Building Regulations required to deem it a bedroom this then begs the question why when it was not marketed as such when you bought it? Developers would not miss something like that.

Why do you think it was not marketed as a bedroom in the first place? Any of the above?
 
Is there any reason why it cannot be advertised/sold as a two bedroom property with a seperate office and then the buyers solicitors could then mention the office potentially being used as a bedroom?

Building Control would ensure the same standard to any habitable room in the roof whether it is called a bedroom or an office. Was your house built on land previously used as employment land?? There is a development local to me where houses were built on land that previously housed a factory so the planning dept put a condition on the planning consent saying that half of the houses had to contain a room for use as a home office. (2 bedrooms and 1 office) Don't ask why or how that was going to be enforced?? Check the original PP.
