AAV height

I have some bad smells in our bathroom especially after draining the bath. There is an AAV fitted but I suspect it may be sticking so plan replace it.

The current AAV is just below the top of the bath and well below sink level. I know it is supposed to be above all outlets but we have never had a problem. The existing one is boxed in behind tiling so I will have to cut this off and lower it a little more. There is no other way without smashing out lots of tiles.

My question is why AAV have to be above all outlets. Is it to stop water leaking? They are basically a one way valve so should stop water coming out of the stack any way. Plus, to let any water out, the whole soil stack would have to be backed up.

The AAV needs to go just below the top of the bath at the tap end.
