Bluff and bluster fails.

I wonder how much profit MedPro made on the gowns. At one point in the judgment, there is correspondence where they claim the price will only cover their costs. I am not sure I believe them. The final contract price was £4.88 per gown.
I would guess the garments cost a few pence each to produce, and a lot of the cost is in the shipping, so who knows. The beeb reported there were other companies that were involved in the procurement, so maybe the arrangements are even more complicated than appears to be the case.
 
I don't know much about the criminal case. What are the fraudulent certificates.
see post 182 or 150 on in the judgement. There is dispute about representation, but its clear somebody faked the testing and an allegation of fraud is detailed in 153.

Most were queuing up to help at cost or less. My firm did a fair chunk for AZ FOC, and my CEO who is normally out for every penny, didn't want our teams to be charging commercial rates. I must admit it was refreshing to see firms who normally compete willing to work together.

So they made many millions, just by taking advantage of the Tory back-scratching arrangements to jump to the front of the queue.

The VIP lane must have helped, in fact it probably inspired them, but breach of contract is not fraud. I doubt plod will get very far as the manufacturer, and possibly some of the supply chain is a foreign jurisdiction. DHSC approved the Order then got them to sign a contract they couldn’t fulfill.

So you set up an off the shelf company, then someone linked to the company recommends it for the VIP lane, the company employs people who know about bulk order from Chinna, use their political connections to chivvy things along, sign the contract, someone else sorts the shipping, and storage is organised in the uk. And you pocket (it would seem) tens of millions net profit. Nice work, almost completely a desktop exercise.

The sad thing is that there were real companies with decades of experience who could supply the correct NHS PPE. They couldn't get near a contract. ARCO one of the biggest suppliers had them on their stocks but was rejected for a contract. If that doesn't spell scam I don't know what does.

These were high demand items at the time. Seem to cost around £2 to produced and ship. The idea of the VIP lane was to rapidly expand sourcing options and bypass normal slow procurement processes, the reality, is it allowed connected people to get a "fixer fee".

If they actually delivered sterile products she’d probably be in the shadow cabinet, but its difficult to attribute the fraudulent act of faking the CE marks to her, she just wouldn't have known.

Happy to go to prison for fraud? You took the money, you fitted the parts

Imagine the fake parts failing and killing the customer

Happy to be prosecuted for manslaughter? You took the money, you fitted the parts.
