Builder changed plans without re submission

Hello
Can you give me some advice. My builder decided to raise the height of our extension without resubmitting planning permission. Originally, we were going to build 2 storeys, but went for 1 instead.

We have re submitted plans to the council but because they are so very different to what was originally agreed, they may need more info.

If the council decided they weren't happy with the new plans, do I have some comeback on the builder. We didn't have a proper contract with them. Can I sue?

Hold on Tiger, a bit more info required first please. Planning Permission is the responsibility of the homeowner. If you decided to go for single rather than double storey why is the build higher? What did you get Permission for? One storey or two? When did you decide to go for single storey? Why weren't revised drawings submitted until after the changes on site happen? Questions questions ....
