Cliff Richard: top lawyer questions legality of search.

A top lawyer(not employed by Cliff)has questioned the legality of the search. Point raised: would a magistrate grant a search warrant if he/she knew of the press involvement? He thinks not, therefore the police withheld this from the magistrate which could invalidate the warrant.

I think there's a lot more to come when Richard's lawyers get going.

Gonna be quite interesting in the next few days.

A mere technicality. Obviously Cliff would have no prior knowledge of the warrant, until it had been executed, so really this "top lawyer" is talking ******. (probably in the hope that Cliff will now rush to employ him for £££ thousands per day. )

How can the arrant be invalidated after the place has been raided?? Do you think the magistrate (or any court in the country) will now declare any evidence (if there were to be a court case) illegally obtained??
 
It happens - if the warrant is not legal then any evidence found would be inadmissible in court.

The same reason that when arrested the formal caution "anything you say etc. etc." is given - if no caution then anything said can't be used in evidence

Exactly. At least someone else understands the law and not just the lawyer who is, apparently, talking sh1te ;)

Is this the Labour MP, who was originally a Solicitor for Richmond Council, who was interviewed by the Police several years ago, regarding sending "Children in Care" to the Elm House Guest House ???
