Decking on a sloping plot

Sorry if this has been answered before, I did a search but didn't turn up much.

Just looking for some guidance from those that may have encountered the same issue.

I am looking at building a deck behind my house. As our back garden slopes down the hill our only really option to create a useable space is to deck it.

Briefly checking regs, it states that a deck higher than 30cm it needs PP.

Because of our sloping plot one side of the deck will be less than 30cm from ground level (highest point), but the other end will be 1100mm from ground level (lowest point).

Am I right in thinking the 30cm rule is applied to the highest point of ground adjacent to the deck, and not the whole deck? Just wondering whether I need PP or I can just crack on and get it done. Hoping its the latter!

Hi James,

I went through this thought process a few years ago, and my interpretation of the following was that so long as you didn't go above the 'standard' ground height next to your house then all is good - the highest point is likely where you step out from a door/path somewhere and carry that on with the decking is all OK. I imagine that the purpose of this is to stop people adding decking out first floor windows or creating a band stand!!

Page 6 of permitted development docs on gov.uk:

"“Height” - references to height (for example, the heights of the eaves on a houseextension) is the height measured from ground level. (Note, ground level is the surface ofthe ground immediately adjacent to the building in question, and would not include anyaddition laid on top of the ground such as decking. Where ground level is not uniform (forexample if the ground is sloping), then the ground level is the highest part of the surface ofthe ground next to the building.)"
