End of jury trials?

what exactly are you putting into AI to get this drivel out?
All factual. In how many ways does your government need to behave like an insane dictatorship before you start to wonder if it might just be one?

Online censorship, compulsory tracking apps on everyone's phones, now getting rid of juries.

Do you not remember the PM going on TV and stating that all the protestors would get harsh sentences and no bail?

What's next?

Removing jury trials has been a vital early component of every historic dictatorial regime

On R5L yesterday, a bloke from Canada said defendants are (or was it were, I don't recall) trial without jury as SOP.

nowt to do with political motives, just better for defendant and victim.

Lady on R5L yesterday said she'd been waiting for over four years, for her SA case to come to court.
Life on hold for all that time.
Shoite.

All factual.
only it is not

its just a ranting post full of falsehoods

compulsory tracking apps on everyone's phones
doesnt exist

Online censorship,
doesnt exist -the online safety bill was created by Tories

Do you not remember the PM going on TV and stating that all the protestors would get harsh sentences and no bail?
he did not..........that was the voices in your head

or typing something online that goes against the state's view of how we should think or is negative about our glorious leader.
thats just a complete lie

This is all about control. The backlog is just the perfect excuse. They don't care about waiting times or victims, they are the justification for the regime pursuing its real goal.
thats just drivel

do let me know when you actually do post a fact one day, I'll get out the champagne to celebrate

I don't see any problem in allowing the defendant to opt out of a jury, if that isn't already allowed.

I'd be willing to believe that the govt shills and supporters will be making propaganda calls to these phone-in programmes.

The delays won't be improved anyway. Currently the judge can go and look at the next case while the jury decides. Now he'll be needed to do the whole lot instead of outsourcing.

In Canada, an accused can generally choose to opt out of a jury trial in favor of a trial by judge alone, but there are exceptions. For the most serious crimes, such as murder and treason, a jury trial is mandatory unless the prosecution agrees to a trial by judge alone. For other indictable offences, the choice is typically made by the accused, though the Attorney General's consent may be required in certain circumstances.

Right to opt out
  • General rule: In most cases, the accused has the constitutional right to choose a trial by judge alone or by judge and jury.
  • Re-election: Under the Criminal Code, the accused has the right to re-elect the mode of trial within a certain timeframe, often after a preliminary inquiry, if there has been a significant change in the Crown's case.

When opt out is not an option
  • Mandatory jury trials: For certain severe offences like murder, treason, sedition, and piracy, trial by jury is mandatory.
  • Prosecution consent: In these mandatory cases, the accused can only opt out if the prosecution consents to a trial by judge alone.
  • Attorney General's consent: In some situations, the Attorney General's consent may be required to waive a jury trial, even for crimes that are not considered "most severe".

Important considerations
  • The right to a jury trial is constitutionally enshrined for crimes punishable by five years or more in prison, but the Criminal Code also provides for it in many other indictable offences.
  • The ability to opt out of a jury trial is a significant choice for the accused, who should consider consulting with their legal counsel to decide what is in their best interest.

The Canadian constitution and legal system is a UK govt shill then.

Always said the only difference between us and Russia is that we don’t have to Que up for bread. Everything else is the same
Like conscription, state controlled media, people who are more right wing than you falling off high buildings, asylum policies, freedom of speech, no effective opposition Come off it, not even your missus would agree with that. Mind you re form haven’t been elected yet.

the public order act 2023 increased powers of police to restrict rights to protest

I dont believe the Labour party have made any changes to restrict protesting
This lot or the last lot?

Clive Ponting?

Serious complex cases like financial fraud are arguably better dealt with by judges sitting alone

Judges listen without deciding, magistrates decide without listening goes the old saying,

Because the bureaucracy is still there, that said they are talking about two lay members sitting with a judge. Maybe we’ll get a French system where the judges will become investigators

All are human beings. We see patterns and place things in boxes.

The brain reinforces decisions made frequently.

I sort of meant that our politicians are as corrupt as any other and our freedoms are now more monitored than ever before. Little by little we are heading in the same direction.

Especially decisions that aren’t challenged because the accused isn’t properly represented because of cuts
