Firstly they have bigger engines and aren't sailing a dingy.
First they have to be detected, then they have to be caught, then they have to be prosecuted, then they have to be penalised, etc.

They are illegally operating a passenger vessel.
Who is 'they' Who are they going to prosecute, if they detect them, if they catch them, if they can identify who to prosecute, etc. ?


In France its a legal requirement for all boats to be registered.
Dinghies don't need registering.

In addition a vessel adapted to carry 12 passengers or more is classed as a commercial ferry or passenger ship. Its a legal requirement for any skipper taking fee paying passengers to be commercially endorsed (qualified and checked). Its also a legal requirement for the vessel to be coded (safety checked) to the necessary standards for its purpose. Then we have the fact that everyone is unlawfully present in France without having cleared customs etc and without the proper visa.. Schengen violations etc. Then you have the assistance of asylum seekers/illegal migrants etc. etc.
Who are they going to prosecute, if they detect them, if they catch them, if they can identify 'the skipper', etc.?


The Law in the UK is slightly different, small craft don't needed to be registered but the rest is pretty much matched in the UK also. If they were not breaking the law, the French authorities would appear to be committing some sort of criminal damage every time they destroy the inflatables?
I think the French police are content that the asylum seekers have no intention of suing them.

Anyone jumping in 12-15 degree water is going to need rescuing pretty quick, no matter what. If they protest, just wait 5-10 minutes until they lose the ability.
Exactly, so why create such a potentially dangerous scenario? And do you think the asylum seekers are aware of the dangers of jumping into the water?
I can imagine the media headlines following the first fatality.... Asylum Seekers died crossing the Channel........

In france any vessel over 2.5m has to be registered.

The above example is probably at least 8M and even the smaller ones come in above 4-5M.

You are aware they are being monitored and escorted by French warships and maritime police.

Yes I’m pretty sure they are aware of how friggin cold the water is.

They may be unaware of how far, busy and choppy it is. Btw. This is a 2.5m dingy exempt from registration - spot the difference?

So why are we giving France more money to detect them if they are already doing that?

We are paying more, because we want them to do more.

Hopefully there were some performance obligations in that deal. I suspect not however.

It's more ideologically acceptable for UK to pay France £63M per year than it is to accept that UK is powerless to do anything.
That wouldn't go down well in right-wing circles.
