You do have a habit of taking issue with large organisations over their supposed illegal practices.
I suggest you set yourself up as a people's champion against such issues. Ypu appear to think you have a better understanding of these issues than a myriad of specialist legal advisors. :rolleyes:

If they were so confident.. why did they feel the need to change it. The original advert was BAMEs only. but yet..

Their FOI response confirms their view that it's a non-job. But also confirms that it is exclusively for BAMEs.. (notwithstanding their later change in stance).

and of course if you read the article they reference.. they clearly missed certain key parts:


from sec 5
- recruiting or promoting a person solely because they have a relevant protected characteristic (without regard to the legal criteria)
- creating schemes to benefit those with a particular protected characteristic, without any evidence that the group in question is at a disadvantage or has different needs

- This is a recruitment based on protected characterstic
- they have not demonstrated that those who are BAME are disadvantaged or have different needs. It's simply that they do not seek work in that sector.

Your interpretation has been proven to be not a true reflection of reality in the past.
They may have decided to change it for genuine reasons.

Their response shows very clearly that they were acting within the requirements of the relevant legislation:
The Stuart Ross Communications Internship is justified as a positive action initiative under Section 158 of the Equality Act 20101 because Black, Asian, and Minority Ethnic communities are underrepresented within TfL’s communication functions and within the wider industry in comparison to the diversity of TfL as a whole and the diversity of London itself.


On the basis of this and other data from across the industry, TfL believes that the scheme is justified as a positive action initiative under Section 158 of the Equality Act 2010 because Black, Asian, and Minority Ethnic communities are under-represented within TfL’s communications functions and within the wider industry in comparison to the diversity of TfL as a whole and the diversity of London itself, where 46.2% of residents identified with Asian, black, ‘mixed’ or ‘other’ ethnic groups according to the 2021 Census. This was distinct from the 17% of residents who identified with white ethnic minorities.

Something runs for over 10 years, suddenly they get a load of attention claiming it's unlawful.. they do a review with their legal bods and someone says "ooh sh*t, we may have a problem lets open it up to people that we can lawfully treat preferentially and also add also expand it".

The scheme predates the 2010 legislation.
It's perfectly normal for schemes offering opportunities to disadvantaged groups to reconsider their target groups from time to time.
You have decided on 1) the illegality of the scheme, and 2) the reason they chose to reassess their target group.
That's pretty normal for you.

The original scheme was set up in 2006, it was renamed in 2016, but still the same scheme.
The criteria was changed in 2018.
It suggests that the BAME criteria was added then:
Due to the success of the scheme and TfL’s continued commitment to diversity, in 2018 TfL expanded the scheme to include new diversity internships in communications and marketing to help address the severe underrepresentation of people from Black, Asian and minority ethnic communities in those industries.

I read both the advert and the JD. According to you: is a white male, non-disabled person from a middle class background encouraged to apply under the criteria? Then ask yourself, what is the opposite of encourage? Then ask yourself is that treating someone less favourably.

They think they can get away with it. Not because its a carefully worded JD, but because they think its isn't a job.
Yih forgot to ask yourself, who will actually apply given the reward and length of job involved.

Somebody with the backing of bank of mum and dad, which negates all of the people that "appear to being encouraged".

As I say it's cleverly worded and triggers the usual suspects.
