Flue Deposits

Been called in to decorate some rooms at an OAP home
one of the bedrooms has a internal flue for the heating boilers, which appears to be of brick and plaster construction.

Some time in the past a stud wall has been fitted to create a bathroom one end of the stud is fitted to this flue.

Raking out a crack between the stud and wall has brought
out a fair amount of black brownish dust some it is small
lumps looking at closely it seems to have been subject to great heat.

Before I take this any further I am correct in thinking this dust is from a leaking flue.
 
It's possible, but since we're not there to see it, how could we tell?
 
as this could be potentially lethal, call in an RGI to check.
as you have "created" the opening, it could be argued you are responsible, so i would not leave it to the old dear to call.
