Garden Room height - adjacent land

Hi - I'm looking to build a garden room within 1 metre of the boundary. The height of the room will be 2.5m but when we add the foundation and sub frame it will add approx 150ml to the height. Firstly is this okay?

Secondly - the garden is 300 ml higher on the left hand side - are we able to take that as the adjacent land so therefore remain within permitted development if we build on the right hand side which is 300ml lower?

no its a maximum 2.5 unless you apply for planning permission
you dont use nearby land just a natural datum point that would replicate what was /is under the building within an inch or so away from the building
if the building is on a sloping site its from the highest natural ground level it covers
 
Thank you - so in that case is it possible to dig down a bit to cover the foundation and frame?
 
just make sure you have a datum point nearby for reference to help you and in case off dispute
