Glue Down LVT - Dip

Hi,

I've paid to have LVT glue down put down, with the floor fitter putting down latex on top of plywood (on top of chipboard then a suspended timber floor). Most of it is fine, but there is a significant dip in one area (typically in what will be a much-used walkway). I had pointed this out to the fitter before he put the LVT down, and he told me that he would sort it.

The dip is still there (shown in the photo), with the fitter trying to play it off as normal to have some dips. They said that they've sanded to try and smooth it, but surely that wouldn't help a dip. I'd welcome any advice on a suitable remedy - I can't see it being any different than take up that area of LVT and try and use some kind of self-levelling compound, which is what I think should have been done in the first place.

They are giving the impression that it's the fault of the subfloor, but they laid the latex and there was no dip before this point?

If you mentioned before and was told it would be fixed but it's not, what is the problem.

Seems clear to me..
Fitter needs to sort it out and if not I'll see you in court
Thanks Wayners, sadly it does seem to be going down an unpleasant route, as they are taking no accountability and blaming everything else (including asking why I didn't put a level on it earlier)!
Thankfully haven't paid a big chunk of the money so will get someone independent in to assess how much it's going to cost to fix. Such a shame as 95% of the work appears fine

I like to call site meetings. That always got a smile and was good to break the Ice.
I called the first site meeting before I started on arrival and often you would get offered tea.
Problem is many customers stay out the way until the end and it's too late to raise concerns.
I think the responsibility lies with the trades to call a site meetings at critical stages and discuss any problems..
Sadly this is not always done and becoming less it seems.
Maybe I'm old school.

The whole house had new chipboard, then ply, then he's taken responsibility for all latex, primer, fitting and adhesive.
My hope is that I can get someone to just take up that impacted area to fill the dip and feather it to give a smooth finish, whereas he is suggesting that it would all need to be redone (but of course not offering to do this and still saying I should just pay for what he's done)

We tend to find chipboard is level as it’s new. So then we go 6mm ply and feather finish.

How did he screed the floor? With a trowel or a pin leveller.

Chipboard was all level, as was the ply (although used 4mm which he specified). Not sure on whether it was a trowel or pin leveller
 
I’m going to get someone else to come and have a look and see if they can just “fill in” and smooth the dip, then take that (and the cost to buy more flooring) out of what I pay, which I think is the only reasonable option I’ve got
