Guttering close to our wall causing damp

Oh dear!
Unfortunately it was approved and built too long ago for the council to do anything, even if they built it closer to your wall than the approved plans.
I've always walked away from jobs in between properties built without enough space for a human being to pass.
Nothing wrong with old guttering, as long as it is maintained.
In any case, their roof is so close to your wall that rain will splash all over it.
Only solution i can think of is some sort of flashing all along your wall from 4/5 courses above guttering to below it, so to protect the brickwork.
 
That's a statutory nuisance.

Contact the council's environmental protection team, make a complaint under section 79 EPA 1990. The environmental protection officer should visit and then issue an abatement letter to the neighbour, giving 21 days to rectify the cause of the dampness or risk prosecution. Ask this will be at no cost to you.

The solution would seem to be inserting some lead flashing into the wall. For this, the neighbour will then need to serve a Party Wall Notice on you. Don't accept self adhesive flashing.
 
Thank you for your replies thus far - we don’t necessarily want to make it formal at this stage as I am worried about the implications when we come to sale our property, so I just want them to undertake the necessary work to protect our wall, we are a young couple and this is our first property I think they think they can bulldoze us into accepting their response. You both mention ‘flashing’ as a possible solution but what is this and how can we present this to them so they know we understand what is required any further advice welcome.
