height above cooker?

We are renovating our old kitchen and intend to put our cooker into the recess of the old chimney breast.

Our builder started on site yesterday and told us that there is a minimum height requirement above the cooker, which our chimney breast falls under - and we therefore need to take out the original arch and re-do a bit higher up.

Has anyone else come across this?

You don't mention make, size or fuel type but http://www.esse.com/pdfs/manuals/cat-install.pdf says there should be 600mm above the cooker top
