Most definitely not. Do you think he knew she was dead driving past him. He didn’t shoot her through the rear window and she wasn’t half way up the road either by the time the third shot was let off.

What does that mean. Are you saying that he had made a decision to fire three shots and so he was unable to stop himself completing those shots even when the danger had passed. A court would laugh at that.
