Is it 5yrs for drawing plan to build on?

I'm thinking of looking to have a new self-build on a plot of land and if passed by the planning & building control, is it still the 5yrs rule still apply to build it within the 5yrs period of the drawing passed?

But once you submit a Full plans Submission or Building Notice to LABC & start work on the site, you can take as long as you want; there is no requirement to complete the work within 3 years.
 
Thanks lads, for example any idea what happened if it's not built in the 3yrs period, would I have to submit the drawing plan again or is it just need to be updated with the latest building regs because the plan already passed in the first place?

If you have not commenced works on site you will have to apply for a whole new application again. There is no guarantee that you will get a second application approved of course. Proving you have commenced work on site varies slightly between authoritys, it was covered in this thread recently: //www.diynot.com/forums/viewtopic.php?t=224962

Once you get Building Regs Approval I believe that the Approval lasts indefinitely.
 
Building Control department's can take action under Section 32...

Section 32 of The Building Act 1984

If the work has not commenced within three years of the deposit of the plans, the Council may, by notice under Section 32 of the Building Act 1984, declare the plans to be of no effect.

If you still wish to proceed with this work a new application will have to be submitted. This application will have to be to the standards applicable at the time of deposit and will require a further fee.

Don’t confuse Planning Permission with Building Regulations, they are two entirely different things. Planning doesn’t (normally) require much detail, once you have planning permission, you then progress to Building Regs.

A new build would normally be done under a Full Plans Submission rather than a Building Notice which is mainly for small jobs & extensions etc. A full plans submission must include detail drawings & a design/construction specification which is then assessed as being compliant with BR’s; it’s effectively signed off before you start but is subject to inspection at the appropriate stages. A building notice can be more risky for a new build as you must be fully aware of BR’s & what you need to do to comply; work is still subject to stage inspection but there is a risk you may not find out certain aspects of the work are non-complaint until completion if it doesn’t get picked up earlier & then your into a horse trading situation with LABC.

Once LABC approve your full submission plans & you give notice work has started or you give notice to LABC that work has started under a Building Notice submission the work will be judged on the Building Regulations in force at that time, it’s not a moving target.

Are you talking about planning or building regs?

If planning then the original permission will have stated a time period, which will most likely have been 3 years but could have been 5 years for an older application. You will need to check the decision notice to see which it was? If you have passed those dates and not started you must reapply with a full application.

If you are talking about building regs then the approval will become invalid if you have not started work before 3 years. Again, you will need to reapply.
