Kitchen fan and Building regulations

Hi I'm asking this questin on behalf f my neighbour.

My neighbour recently had a kitchen extension fitted and the house was required at the same time.

we have a electrical inspecion certificate which has already been handed to building control, yet the building control has asked about the absence of a kitchen fan.

The bathroom fan was installed at the same time as there is no pening window in the bathroom, however since the Kitchen has a large opening window, and an was not installed.

With regards to the window, is it actually legally required to have this fan installed?
So far we have not been able to contact the electrican, but he did mention he would be working away this week.

Can anyone clear this up as the building controller is refusing to give a completion certificate on a few thngs including this one (but also not related to the electrics).

Its really a question for the designer/architect. But I do not believe there is an absolute requirement in Building regulations for there to be an extractor fan in a kitchen (although IMO its a darn good idea.)

Ask your Building Inspector to quote you the regulation that says you must have one.

Regulation 3 of the Building Regulations defines an extension to an existing house as ‘building work’. Consequently, normal building control notification procedures will apply. All new work must comply with the applicable requirements of Schedule 1 to the Regulations, including any electrical work which must comply with Part P of Schedule 1 to the Regulations, and the ventilation which must comply with Part F.
Section 3 of Approved Document F (2006) provides guidance on how to comply with the ventilation requirements for work on existing buildings. In particular, paragraphs 3.11 – 3.15 are relevant because they apply to the addition of a ‘wet room’. Both kitchens and bathrooms are classed as wet rooms for Approved Document F (2006).

Thank you for taking your time to help me.

The building inspector said specifically that a fan would be needed in the bathroom because of the non pening window, However If the kitchen window opens (which it does) then I don't see how this has contraveined any regulations at all?


However at the time, I have been told that the building inspector never mentioned any kitchen fans during his previous inspections.

The question is, how do we explain this to him without casuing more trouble?

It is not a matter of causing trouble.

Apparently will not give you a completion certitficate because (he says) that you have not met a Building Regulation. You are merely asking for a clarification of which regulation you are asupposed to meet.

Its a bit like a policeman arresting you for an offence.
You say "why am I being arrested?" he says that "you have caused harassment, alarm or distress contrary to the Public Order Act 1986 Sec 5"
You ( and your lawyer) can look it up and say "blimey, I did cause alarm, didn't I"

The same with Building Regulations.

Many Building Inspectors have little folk law items in their brains and they believe it to be true, even though it may not be.

Ask for clarification, in a nice way. Then you can deal with it.

Are policemen exempt from that law?

Because when they arrest someone....
