Neighbours log burner flue in my loft.

Please help. There is a central crack in my lounge wall. My neighbours have a log burner and apparently the flue in my loft is my neighbours. Occasionally I've smelt smoke indoors. Please see attached photos.why would it be coming from their side should this not be on an outside wall? New boiler installation workers discovered this.

Please help what can I do? There is a central crack in the lounge wall probably do to the heat from the log burner. This was brought to my attention whilst having a combi boiler fitted.

Seems odd that this ended up in your loft. Assuming the fire wall is in the right place, how did the get agreed?
 
Why would it have been "agreed." If it was done by a cowboy it would just get done and the cowboy is on his horse and long gone before anyone finds out.

Is there no chimney in your neighbours house

why would it need to exit through your side
 
Seems odd that this ended up in your loft
Not just odd but also potentially dangerous.

It doesn't appear to be a twin wall pipe nor does it appear to have any thermal insulation.

If your neighbour's log burner overheats then your loft is at risk of fire. The rafters could be ignited.

If the house is rented then take the matter up with your land lord. If you own the house then get advice from your local council's Building Control Office,
 
I was in a loft last week and noticed an elbow like that that seem to come from the cavity or next door.

I can’t see it being a neighbours flue.
 
Flues through neighbouring properties used to be allowed with gas appliances years ago but no new appliances can flue through neighbouring properties now .The rules are possibly the same for log burners could be worth contacting HETAS and asking if this is allowed .
 
Is it is there without permission historically, or carried when you were owner. The neighour may have rights or accrued them over time.
