new and old downlights

Room has downlights, not the fire rated ones.

They have been there for a few years.

Owner wants to add a two more

Owner lives on the ground floor of a large house converted into flats

I think that the new lights should be fire rated. I also think that I should change the old ones to fire rated.

That make sense to me, but technically do I have to change all the lights
 
This depends on whether that conversion to flats was done recently, and/or under a Building Notice - in which case the ground floor ceiling would be fire-rated and in need of fire-rated fittings.

However, many such (older) conversions were carried out leaving the existing ceiling in place. So 'technically' the additional lights need no better protection than the existing fittings.

Why not explain this to the ground floor owner/tenant and leave it up to him?
Because you can't insist on changing all the fittings on a non-fire-rated ceiling just for the sake of it.....

You should try to get the resident to see the sense in having that done, but you aren't responsible for the existing lights so you aren't obliged to do it and you can't force him.

Have you considered Parts E and L as well as B?
