New roof terrace overlooking garden/kitchen

I would maybe start with an amicable discussion with them, to see what their intentions are. I would imagine that most of the time spent on a roof terrace would be spent sitting down, for a start. So the privacy issue might not be as severe as you think. I wouldn't jump straight in to either falling out, or ringing the council.
