That is generally the HSE practice, they much prefer to "educate" rather than prosecute!
So it often goes: -
Verbal advice
if ignored
Improvement notice
if ignored
Prohibition notice
if ignored
Consideration of prosecution
In this case they seem to have gone direct to a Prohibition Notice, which they can. It is rare I understand to go direct to prosecution unless and actual death or injury (or potential for either) has occurred.
Certainly any cases where I have been involved with them have followed the above route
