I have to prove to the Planning people that my garage was built with my house (built 1950) - this is because if the garage was built at the same time it counts toward my allowance (of 50% on orginal footprint).

My question is this - although I can clealy see it is original (same brick, orginal steel windows etc) I have no proof.

Is there somewhere I can get this? Do the land Registry hold original documents etc?

Any ideas welcome.

The deeds should have the info in the form of an outline plan or mention of it in the text.

But the planners should have the original permission - ask them what they have done with it and why it is not available - "Have you lost it? Why should I have to prove something when you have failed to take care of documents under your control? I'm sure a Judge would not be too happy to learn this when I claim my costs back, or the Local Government Ombudsman may take a dim view of this"

What evidence do they have to dispute that the garage was there?
 
Try using the following argument: (which is based on planning case law)

Tell them that reasonable proof here is the balance of probablilities. The garage is same style, same brick and it's construction indicates that it was built with the original. Therefore, based on the balance of probabilities, the garage is original. Ask them if they have any evidence which leads them to believe otherwise.

Strictly speaking the case this came from was about certificates of lawfulness but I have often been able to convince planners that it is transferable to other situations.

Also, are there any other examples of the same house with garage in the area? if so this could strengthen (or weaken) your case.
