Please help, certificate of lawfulness

Our landlord has applied for a certificate of lawfulness, so that an atrium can be filled in for the top four floors, currently office space. The building is on a central retail street in the West End.

We are several flats occupying the top floor (with office space at one side of the rectangular atrium). Two of the flats have most of our windows facing the atrium, and three others have front doors (although no windows) atrium- facing.

It would be difficult for the two flats to have more than two thirds of all natural light removed as a result of an infill. The landlord wishes to develop the building into retail space, and is keen to move us out.

Anyone able to advise how to deal with this?

If your landlord has got a cert of lawfulness, they either must already have PP or it is a permitted development and PP is not required.

Unless full planning permission is applied for, then you can't do much with regards to the CLD application

However there may be party wall and right to light issues if the work proceeds, which you could pursue along with any full planning application which might be made.

Also check your lease terms to ensure that they are complied with

Thanks for the replies. Will check the lease carefully. CLOPD application result is not known yet, so possibly it may go to full PP.
