Roof windows

We bought (from B&Q), and fitted two MOE roof window. MOE means Means Of Escape. We needed MOE because of building regulations. Now we find the windows are not MOE and it must have had incorrect markings on the pakaging. We now must replace both windows. B&Q won't take any responsibility :( Has anyone else had this sort of problem ?

If you can prove the by means of the packaging, warranty, instructions or any other way (i.e. they still sell the same product) that the windows were sold as suitable for MOE & they aren’t, go back to B&Q & insist on a refund as the packaging is misrepresenting the product; kick up a fuss as they don’t have a leg to stand on!
 
I agree with Richard C that you need to have 'reasonable proof' they were sold as MOE. And if B&Q say that is how they received them from the manufacturer and so you have to take it up with the manufacturer you can tell them to get their facts straight...

You bought them from B&Q, therefore your contract of sale is with B&Q and NOT with the manufacturer. Simple consumer law applies and your local Trading Standards office would assist you if you encounter any difficulties. (Unless you bought them as part of your business in which case it gets a little more convoluted).
