Can anybody advise me on the legality of connecting a new soil pipe into my neighbours drain run
 
Can you elaborate a bit more :? What makes you think it's exclusively his drain run? Is it a private foul drain connection to the main sewer? Not a septic tank I assume? Is this connection to be on his property or yours? Has he given you permission?
 
my customer has an existing drain run as does the neighbour, but the position of the proposed new bathroom and its soil pipe will not give enough fall because of the distance away, however the neighbours man hole would be ideal, i have not approached the neighbour i just wanted to know if there would be any objections from a planning point of view, thanks for your reply any help would be greatly appreciated
ps both drain runs are in a straight line to the main road
 
You don’t need Planning for a new foul drain. The section of drain within your boundary is (usually) owned by & the responsibility of the property owner, up to connection into the main foul drain. You can do more or less what you like if the drain is privately owned as long as you conform to local water authority by-laws with regard to what you’re discharging into the drain & the construction of the drain & it’s connection conforms to Building Regulations.

The biggest fly in the ointment will be getting permission from the neighbour which you must have. Personally I would not even consider it without some sort of legally binding covenant to rights of use & a shared maintenance responsibility agreement being written into the deeds for the section between the new manhole & main drain as I would have no control over what you flushed down there, would your customer be happy to accept that & paying for it? Personally I still wouldn’t agree to it as shared drains can lead to lots of arguments. Might be more expense & trouble than it’s worth!

What fall are you working on - would it be 1:40 :wink: You can get plastic drain to work on less than that - Also have you checked the levels with something accurate like a Cowley Level.
