speeding?

if its not a requirement of your MOT to have your speedometer tested/calibrated, and i dont think it is , if you were caught going 40mph in a 30mph area but found out that your speedometer was faulty and it showed 30 when you were doing 40 could you get off with the fine and points. just a thought

I very much doubt it. It's up to the owner to make sure that the car is maintained correctly and you could not put the onus onto the test station because they don't even test it.
 
MOT class 4 (cars) speedo is a non-testable item - pass and advise inop accordingly. you don't even have to advise.

Think it must work under the Road Vehicles (construction and use) regs though.
