Tree issues

Can anyone help ?
My neighbour has a number of trees on the boarder of our properties (unfortunately the trees are situated on his side) but are starting to grow high and out of control.
I have worries that these may affect my property and a drain running through my property. I have tried to suggest the trees are pruned to control, this appears to be unpopular with my neighbour. Has any one got any helpful advise to help me in this situation.

Offending trees come under the law of private nuisance.

But if you went to law, the onus would be on you to prove that the tree roots were interfering with your property in some way.

Merely 'being worried' would not suffice - there has to be tangible proof that damage has actually been caused.
