Tough, no amount of bob the builder scenes that you keep repeatedly posting will over turn the court ruling. No murder was committed and the agent acted exactly as he was entitled to do.

That is a very astute observation. Nobody is really arguing that at the moment, but that would be the second test. The first test is whether the agent himself is at risk of serious injury. The second test is whether anybody else is at risk of serious injury.
