1st floor window in side of house

Hi,

I am looking to put a window into my house on the first floor, facing sideways. I understand that it needs to be obscured and non-opening, unless 170cm off the floor. Does this mean I can have a window with the top part opening if the opening bit is 170cm off the floor, or does the whole window need to start that far off the floor for any part to be opening?

The opening part needs to be min. 1.7m above floor level, not the actual cill. So you’ll end up having a top or fan light type window.
