Its connected to the Bath Kev

Reason for not using them upstairs is he depth of the seal.

Shallow bath traps can "pull" ie the water can get sucked out - but it depends on how long the waste pipes are etc.
There is a long bath trap with an effective 75mm seal even though it isn't that deep, also with air admittance valves to stop syphoning:

You seem to have 2 appliances connected to the same trap and the smaller one looks as if it will not drain away properly. :(

Suggest you fit a shallow trap and an AAV to let air in to protect against loss of seal, and reroute the other pipe so it drains away as water will not flow uphill. :D

the wc overflow runs in there at the moment though i have been told he can do away with that and just run it in to the pipe on the wall.what is an aav.

thanks all.where would the aav be fitted.sorry i know nothing.
