my neighbour is taking a fence down thats been there for 6years he has only lived there for 2 years but is a bit of a neighbour from hell any ideas what i can do he says its his because the people who lived there before him put it up

Does not matter who put the fence up.
You will need to look on the land register to see if it is your responsibility.
Who did your conveyance work ? did they not give you a copy ?
 
we gave the people who lived there before permission to take down original fence to have an extention because he had an accident and needed a disabled toilet and shower room downstairs they put the fence back when extention was finished
 
You need to find out who's property the fence is on, and who's responsibility it is to maintain the boundary. Doesn't matter who actually paid for it and did the work. If its on your property (hard to tell usually) then he can't touch it - that would be trespass (not a criminal offence, though). Is he going to replace it with anything?

One guide but NOT in-fallible is the posts are normally on the owner's side of the fence.

But try to come to a mutual agreement. If that fails then putting up your own fence (and losing the use of 6 inches of land) may be cheaper than any legal action against your neighbour.
