Building next to private drain pipe

Hi, i am in the process of building an extension. i have a build over agreement to build over a sewer but i have also found another drain pipe and need some advice.
How close to a private drain pipe can i build foundations. the pipe will be next to them. i cant seem to find the answer anywhere. The drain will no longer be used.

If the "private" drain is to be removed then grub it out and concrete over.
