Yes all communication is happening over email so have in writing “With regards to the independent contractor, they have been brought into the matter and therefore I require their assessment as this is key evidence in this dispute.

Removing the old materials, would be part of doing the job anyway, whether it was as it was originally, or as you find it now. Ask him to put it in writing, what is wrong with it as it is, and separately - precisely what he is quoting to do.
I would also look at getting other quotes for the work, but making sure you tell them exactly what you want done.
